This online contract is an important legal document which is legally binding and affects your rights.You should read this document carefully before clicking to submit a Solution within the for Tomorrow initiative.
1. Object of the initiative
HYUNDAI MOTOR COMPANY and the UNITED NATIONS DEVELOPMENT PROGRAMME, through the for Tomorrow initiative, as per the terms of their Framework Cooperation Agreement (FCA) and Pro-Bono Agreement (PBA), wish to disseminate the solutions in the area of sustainable development, of the participants (the “Solution Owners”) in the for Tomorrow initiative, expressed within their submissions to the initiative (the “Solutions”), while allowing such Solution Owners to retain their intellectual property.
The for Tomorrow initiative therefore aims to allow the use, disclosure, protection, promotion and marketing of the Solution, with objectives of transparency, transfer of knowledge and communication, promotion, sharing and open access, while respecting the Solution Owners’ IP rights.
2. Theme
Your Solution must be a sustainable development project through which you, alone or with one or more identified collaborator(s):
- have solved; or
- are in the process of solving, after feasibility tests have been performed; a sustainability issue in your community.
3. Participants and conditions of participation
The initiative is open to adults as well as to minors of age who have reached the age of 16 at the time of the filing of their Solution. The participants may reside in any country where the rules of this contract, and of the various online agreements of the for Tomorrow website, are valid.
The Solutions must be described in English.
A Solution can be filed individually or with one or many collaborators. THE SOLUTION OWNER, WHEN FILING THE SOLUTION WITH THE FOR TOMORROW INITIATIVE, MUST DECLARE, AT THE RISK OF BEING DISQUALIFIED, THE INVOLVEMENT OF ANY COLLABORATOR(S) IN THE SOLUTION, THE PIP AND / OR THE PIN (AS DEFINED BELOW), IF SUCH IS THE CASE, UNLESS SUCH COLLABORATOR(S) HAVE WAIVED IN WRITING THE RIGHT TO BE NAMED AS COLLABORATOR(S).
It is forbidden to send the same project under different names or else it will be excluded from the valid Solution entries within the initiative.
The specifications governing the presentation and filing of the Solution by the Solution Owner are available on the for Tomorrow website and appear on the relevant webpages as the Solution Owner is filing his or her Solution.
The full rules of the for Tomorrow initiative are comprised of this Contract to enter the for Tomorrow initiative, as well as of the Terms of Use, the Privacy Policy, the IP Policy and the Cookie Policy. Please consult those documents before accepting the present Contract.
The HYUNDAI MOTOR COMPANY and the UNITED NATIONS DEVELOPMENT PROGRAMME will not reimburse any expenses incurred by the Solution Owners to participate in the for Tomorrow initiative.
Any public communication by a Solution Owner regarding the initiative and the results will mention the sponsorship of the HYUNDAI MOTOR COMPANY and UNITED NATIONS DEVELOPMENT PROGRAMME. Solution Owner accepts and understands that ehe name “United Nations Development Programme” is the exclusive property of UNDP. The UNDP name “United Nations Development Programme” is protected under international law. Unauthorized use is prohibittted. The name “United Nations Development Programme” may not be copied or reproduced in any way without the prior written permission of UNDP.
4. How to share a Solution within the initiative
Solutions Owners must present their Solution within the for Tomorrow initiative by using the “Share Solution” pages within the for Tomorrow website, completing the online forms which are included in such section, and filing the appropriate documents which are requested in the same section. All required steps must be filled prior to the submission of the Solution, and the relevant web pages may not allow the Solution Owner to continue to a next step unless the previous step is completed.
The deadline to submit a Solution as an entry in the for Tomorrow initiative for the 2021 edition of the Spin-Off assembly is by end of August 2021.
When a Solution is entered, the Solution Owners will be able to see on their dashboard that their solution has been entered. Within the following days, the for Tomorrow moderation team will review the Solution to either:
- Approve for publication on the website; or
- Request edits.
Solution Owners will receive an email in both cases, with specific notes if edits are required for publication, and a confirmation of eligibility if the Solution is suitable for publication.
Important: Only one round of edits is permitted.
The HYUNDAI MOTOR COMPANY and the UNITED NATIONS DEVELOPMENT PROGRAMME reserve the right to exclude from the initiative any participant who, or Solution which, does not comply with any of the specifications of the “Submit a Solution” pages within the for Tomorrow website, or any of the conditions of this Contract to enter the for Tomorrow initiative, as well as of the Terms of Use, the Privacy Policy, the IP Policy and the Cookie Policy.
5. Applicable rules
The Solutions must be presented with texts, as indicated in the “Submit a Solution” pages within the for Tomorrow website. Such texts may be supplemented by videos, images, etc.
The Solution Owners must retain a copy of any documents they file.
6. Intellectual property
The Solution Owner as well as the HYUNDAI MOTOR COMPANY and the UNITED NATIONS DEVELOPMENT PROGRAMME must comply with the IP Policy governing the for Tomorrow site and the for Tomorrow initiative. Such IP Policy is included in this Contract as if it were stated at length.
The Solution Owner (and his or her collaborators if applicable) grant(s) the HYUNDAI MOTOR COMPANY a worldwide, free, non - exclusive, irrevocable license, for non - commercial purposes, without time limits and royalty - free, allowing the HYUNDAI MOTOR COMPANY to use, review, copy, reproduce, translate, adapt, improve, distribute, present in public, and make summaries of the Solution and the Intellectual Property that the Solution Owner or a collaborator has developed, as part of the Solution, exclusively for purposes related to the for Tomorrow initiative and to promote exchanges and the dissemination and increase of knowledge in the area of sustainable development.
The Solution Owner must ensure that any collaborator(s) to the elaboration of the Solution has or have accepted the previous paragraph in writing, and the Solution Owner must retain such writing as a part of the Solution documents.
The HYUNDAI MOTOR COMPANY may, but does not have the obligation to, in the exercise of its rights mentioned above, produce or require a third party to produce video and audio messages, press releases, emails, articles, books and other written communications, websites, webpages, and any other communication to promote the Solution Owner and / or the selected Solution(s) or any of the share Solutions.
The Solution Owner may be required to be involved in the production of the above, and will make him or herself reasonably available in relation with such endeavour.
Each Solution Owner agrees that the HYUNDAI MOTOR COMPANY may publicize and / or include in the for Tomorrow website his or her name, photo, place of origin and CV, and specifically authorizes the HYUNDAI MOTOR COMPANY to use his or her name, photo and place of origin within any and all communications related to the for Tomorrow initiative.
7. The pannel of connectors and the determination of the solution owners at the Spin-Off Assembly
The pannel is composed of representatives of the UNITED NATIONS DEVELOPMENT PROGRAMME, as well as professionals from the world of sustainable development. The composition of the pannel is determined by mutual agreement between the UNITED NATIONS DEVELOPMENT PROGRAMME and the HYUNDAI MOTOR COMPANY.
The panel's decisions in relation to the conduct of the organisation of the Spin-Off Assembly showcasing of the most inspiring solutions and the choice of the participants are final and not appealable.
8. Chosen Solutions
The owners of the selected Solutions will be invited to take part in an on-site, two-day event with the participation of the United Nations Development Programme.
After such event, some of the chosen Solutions may be deployed in the UNITED NATIONS DEVELOPMENT PROGRAMME’s Accelerator Labs, a network of agile, in-the-field teams promoting sustainable development around the globe.
A representative of the HYUNDAI MOTOR COMPANY will personally contact the chosen Solution Owner(s) to inform them of the outcome of the selection.
The chosen Solutions shall also be announced on the for Tomorrow website, as of September 2021.
9. Possible editing of Solutions
The HYUNDAI MOTOR COMPANY may review, adapt, improve and make summaries of the Solution that the Solution Owner (and / or one or more collaborator(s)) has developed, exclusively for purposes related to the for Tomorrow initiative and to promote exchanges and the dissemination and increase of knowledge in the area of sustainable development.
10. The processing of personal data
The personal data of the participants is processed by the HYUNDAI MOTOR COMPANY as described in the Privacy Policy governing the for Tomorrow website.
11. Acceptance
Participation in the for Tomorrow initiative implies full and unqualified acceptance of this online agreement, forming the contract between the parties. This contract is governed by the laws of the province of Quebec, Canada, as well as by the laws of Canada which apply therein. Any claim or litigation relevant to this contract or to one or more of the policies which are referred to within this contract must be presented to the appropriate tribunal within the District of Montreal, Quebec, Canada. In case of force majeure, the HYUNDAI MOTOR COMPANY reserves the right to postpone, shorten, extend or cancel this initiative without any liability on the part of the HYUNDAI MOTOR COMPANY, the UNITED NATIONS DEVELOPMENT PROGRAMME or its agents and subcontractors.
